Terms of Service

Effective date: September 17, 2026 · Posted: September 3, 2026
Previous version: July 1, 2026.

Welcome to Pooldit. These Terms of Service ("Terms") govern your use of the Pooldit website and application (the "Service"), operated by Pooldit, LLC, an Idaho limited liability company ("Pooldit," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

Please read Section 1.13 before you agree. It says that almost every dispute between you and Pooldit is decided by an individual arbitrator instead of a judge or a jury, and that you give up the right to bring or join a class action. You can opt out of that section within 30 days by emailing support@pooldit.com.

1.1 Eligibility

You must be at least 13 years old to use Pooldit. By using the Service, you represent that you meet this requirement and that your use of Pooldit complies with all laws applicable to you, including any laws governing fantasy sports, prediction games, or similar activities in your jurisdiction. If you are under 18, you represent that you have a parent or guardian's permission to use the Service.

These Terms are a contract. If you are under 18, or under the age of majority where you live, a parent or guardian must read these Terms and agree to them on your behalf, and that adult is bound by them along with you and is responsible for your use of the Service.

1.2 What Pooldit Is

Pooldit lets users create and join sports pick'em pools with friends, tracked using an in-app virtual currency ("dits"), virtual wager units ("units"), and virtual wager nits ("nits", the currency inside Allowance-format pools). Dits, units, and nits have no cash value, cannot be purchased with real money, cannot be redeemed, exchanged, or cashed out for real money or any other thing of value, and exist solely to track in-game standings and bragging rights within the Service. See the Entertainment Purposes Only Disclaimer below for more on this.

Pooldit is not a gambling site. We do not take, hold, or pay out real-money wagers, and there is nothing on Pooldit you can cash out.

Dits, units, and nits are a limited, personal, revocable license to use a number inside the Service. They are not property, not a balance we owe you, and not something you can sell, transfer, or take with you. We may adjust, correct, reverse, or void any dit, unit, or nit balance, and we may change how any of them work. They end when your account ends and when the Service ends, and we owe you nothing for them at that point.

Entertainment Purposes Only Disclaimer

Pooldit is for entertainment purposes only.

  • Dits, units, and nits are virtual, in-app tracking currency only. They have no cash value, cannot be purchased with real money, and cannot be redeemed, exchanged, transferred for, or cashed out for real money, cryptocurrency, or any other thing of value.
  • Pooldit does not operate, facilitate, or endorse real-money gambling or wagering of any kind. Any arrangement a pool's members make to exchange real money or anything of value based on pool results is entirely outside of and unaffiliated with Pooldit, made at those users' own risk and responsibility.
  • Sports odds, lines, and statistics shown in the app are provided for entertainment and informational purposes, sourced from third-party data providers, and may contain errors or delays. Nothing on Pooldit constitutes betting, financial, or professional advice.
  • Use of Pooldit does not create any right to winnings, prizes, or compensation of any kind beyond in-app standing and virtual currency.

1.3 Accounts

You're responsible for maintaining the security of your account credentials and for all activity under your account. Notify us promptly at support@pooldit.com if you suspect unauthorized access.

1.4 Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to other accounts or Pooldit systems; harass, abuse, or threaten other users (including in pool chat); or use the Service to facilitate real-money gambling, wagering, or any exchange of dits/units/nits for money or value outside the platform. Pool commissioners and members are solely responsible for any arrangements they make with each other outside of Pooldit; Pooldit does not facilitate, endorse, or have any involvement in such arrangements.

You also agree not to scrape, crawl, or harvest data from the Service — including the odds, lines and scores we license from other companies — and not to use bots, scripts, or any automated tool to create accounts, make picks, or send messages. Do not resell or redistribute what you get from the Service, and do not work around any limit, lock, or paid feature in it.

1.5 Your Content and Chat

Pool names, chat messages, and other content you post ("User Content") remain yours, but you grant Pooldit a license to display and use that content as needed to operate the Service. Don't post anything unlawful, infringing, or abusive.

We are not obligated to review or monitor what users post, and generally we do not. We may remove any content, close any pool, or suspend any account at any time, with or without notice, if we believe it breaks these Terms or creates a problem for other users or for us. If you believe something on Pooldit infringes your copyright or another right you hold, email support@pooldit.com with enough detail for us to find it and we will review it.

1.6 Termination and What Happens After

We may suspend or terminate your account for violating these Terms. You may stop using the Service at any time.

When an account ends, for any reason: your dits, units, and nits are forfeited and are not paid out or converted into anything; subscription fees already charged are not refunded except where the law requires it; pools you commissioned may be closed, handed to another member, or left running, at our discretion; and your picks and messages may remain visible to the pools you were in, because they are part of those pools' history. Sections 1.2, 1.5, 1.7, 1.8, 1.9, 1.10, 1.11, 1.12, 1.13, and 1.14 continue to apply after your account ends.

1.7 Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not promise that the Service will be uninterrupted, secure, timely, or error-free.

Sports odds, lines, scores, and results shown on Pooldit come from third-party data providers, and may be inaccurate, delayed, or incomplete — Pooldit is not responsible for the accuracy of this data and has no control over when a provider corrects it.

Everything Pooldit calculates is provided as-is as well. Standings, scoring, dit, unit and nit balances, allowance ledgers, payout splits, Ditpull, Unit ROI, hit rates, and every other figure the Service computes may be wrong, late, or incomplete. We may correct, recalculate, reverse, or void any of them at any time, at our discretion, and we owe you nothing when we do. Do not rely on anything shown on Pooldit for a decision that matters to you. If you act somewhere else on something you saw here — at a sportsbook, in a private wager, or anywhere off the platform — that is your decision and your risk alone, and Pooldit is not liable for what it costs you.

We may change, suspend, or discontinue any part of the Service — features, leagues, sports, pool formats, or all of it — at any time and without notice. We are not liable for any delay or failure caused by something outside our reasonable control.

To the maximum extent permitted by law, Pooldit and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from your use of the Service. The total liability of Pooldit and its owners, employees, and contractors to you for all claims taken together is limited to the greater of (a) the amount you paid Pooldit in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow some of these exclusions or limits, so parts of this section may not apply to you.

1.8 Subscriptions and Billing

Players Club is a paid subscription to Pooldit. If you subscribe, you agree to pay the price shown to you when you sign up, plus any tax, and you authorize us and our payment processor to charge your payment method for it. That is a real obligation: the Players Club fee is money you owe Pooldit, and it has nothing to do with what your pool plays for.

Players Club renews automatically for another billing period until you cancel. To cancel, email support@pooldit.com from the address on your account and tell us you want to cancel; cancellation takes effect at the end of the billing period you have already paid for, and your Players Club features stay on until then. When we add a cancellation control inside the Service, you will be able to use that instead. Fees already paid are not refundable except where the law requires a refund. We may change the price or what the subscription includes; we will tell you before a change applies to one of your renewals, and continuing to subscribe after that is how you accept it.

Payment is handled by our payment processor, which collects your payment information directly. Pooldit does not collect or store your card details — see the Privacy Policy for what we do keep.

Pooldit is not an accounting service for real-world money. The only money Pooldit handles is what you pay us for a subscription. We do not track, hold, escrow, collect, distribute, or report on money that pool members exchange with each other, and we will not produce records, statements, tax documents, or accounting of any kind for it.

1.9 Pools, Commissioners, and Arrangements Outside Pooldit

A pool commissioner is another Pooldit user, not a Pooldit employee, agent, or partner, and does not speak or act for us. Commissioner tools — creating and configuring pools, inviting and removing members, making proxy picks, adjusting settings — are provided as-is for that user's convenience, and what a commissioner does with them is between that commissioner and their members.

Pooldit is not a party to any arrangement between pool members, or between members and a commissioner — and that includes any arrangement to collect, hold, or pay out real money or anything of value. We do not verify anyone's identity. We never hold anyone's money. If a commissioner or another member takes your money and does not pay you what you think you are owed, that is between you and them: Pooldit has no obligation to investigate, mediate, refund you, replace what you lost, or make you whole in any way, and you agree not to bring a claim against Pooldit over it. Whatever rights you have in that situation, you have them against that person, not against us.

1.10 Release and Indemnification

You release Pooldit and its owners, employees, and contractors from any claim, demand, or damages of any kind arising out of a dispute between you and another user, including anything to do with a pool, a commissioner, or money or value exchanged outside the Service.

You agree to defend, indemnify, and hold harmless Pooldit and its owners, employees, and contractors from any claim, loss, liability, or expense — including reasonable attorneys' fees — brought by someone else and arising out of your use of the Service, the pools you run or join, the content you post, your breach of these Terms, or your violation of any law or of anyone else's rights. We may take over the defense of any such claim at our own expense, and you agree to cooperate with us if we do.

1.11 Emails and Notices

By creating an account you agree to receive email from us about the Service: confirmations, invitations, pick reminders, pool activity, billing notices, and changes to these Terms. Some of that email is part of operating your account and cannot be switched off while the account is open; the rest you can control in your settings or through the unsubscribe link.

When you send a pool invitation you are sending it in your own name, to someone you actually know. Do not use invitations to send unsolicited mail, and do not send them to purchased lists or to people who have not agreed to hear from you.

Notices to Pooldit go to support@pooldit.com. Notices to you go to the email address on your account and count as received when we send them.

1.12 Governing Law and Where Disputes Are Decided

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. For any dispute that is not subject to arbitration under Section 1.13, you and Pooldit agree to bring it only in a state or federal court located in the State of Idaho, and each of us consents to the personal jurisdiction and venue of those courts.

1.13 Binding Arbitration and Class Action Waiver

Read this section. It changes how a dispute between you and Pooldit gets decided, and it limits rights you would otherwise have.

You and Pooldit agree that any dispute, claim, or disagreement between us — whatever it is about, and whether it is based on a contract, a statute, or anything else — will be resolved by binding individual arbitration rather than in court. This applies to disputes that come up after these Terms end, and this section survives the end of your account.

You and Pooldit are each giving up the right to a trial by jury and the right to have a dispute decided by a judge. An arbitrator decides it instead. The arbitrator's decision is final, and a court can enter it as a judgment. Arbitration is less formal than a lawsuit: there is less discovery, and there is almost no right of appeal.

No class actions. You and Pooldit may each bring a claim against the other only on your own behalf, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. An arbitrator may not combine more than one person's claims and may not preside over any class or representative proceeding. If a court decides this paragraph cannot be enforced as to a particular claim, then that claim — and only that claim — goes to court under Section 1.12, and the rest of this section still applies to everything else.

Small claims court is still open to you. Either of us may instead bring an individual claim in small claims court, as long as it stays in that court and stays individual. Either of us may also ask a court for an order to stop the misuse of intellectual property.

How the arbitration works. It is administered by a recognized consumer arbitration provider under that provider's consumer rules, and takes place in the State of Idaho or — at your choice — by phone, by video, or on written submissions alone. The Federal Arbitration Act governs this section; Idaho law governs everything else. Each of us pays our own attorneys' fees and costs, except where the provider's rules or the law require otherwise.

Talk to us first. Before either of us files anything, email support@pooldit.com describing the problem, what you want, and how to reach you, and give us 30 days to try to work it out. We will do the same before we file anything against you.

You can opt out of this whole section. You have 30 days: within 30 days after September 17, 2026 (the effective date of the version that first included this arbitration section), or within 30 days after you first create your account, whichever is later. Email support@pooldit.com from the address on your account, with the subject line "Arbitration Opt-Out," and say that you are opting out. That is all it takes. Opting out is free, it changes nothing else about your account, and we will not treat you differently for doing it. If you opt out, disputes go to the courts named in Section 1.12. If you do not opt out within those 30 days, this section applies to you.

1.14 General

If any part of these Terms is found unenforceable, that part is narrowed or removed to the smallest extent necessary and the rest stays in force. If we do not enforce something right away, we have not given up the right to enforce it later. These Terms, together with the Privacy Policy and the Entertainment Purposes Only Disclaimer, are the entire agreement between you and Pooldit about the Service and replace anything said before. You may not transfer these Terms or your account to anyone else without our written permission; we may transfer them to an affiliate or to whoever acquires Pooldit's business. Nobody other than you and Pooldit has rights under these Terms.

1.15 Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the updated Terms.

The effective date at the top of this page always tells you when the current version took effect, and the lines beside and under it tell you when it was posted and what it replaced. If we make a material change — anything that meaningfully changes what you pay, what you give up, or what we owe you — we will tell you by email or by a notice inside the Service at least 14 days before it takes effect. If you do not agree to a change, stop using the Service and cancel any subscription before the change takes effect. A change does not apply backwards to a dispute that already existed.
